Terms & Conditions

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Homenest Retail Tech India Pvt Ltd, operating as HINCH ("Company", "we", "us", or "our"), governing your access to and use of the website hinch.in, mobile application, and all related services (collectively, the "Platform").

By accessing or using the Platform, creating an account, or making a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must discontinue use of the Platform immediately.

You must be at least 18 years of age to use the Platform. By using HINCH, you represent and warrant that you are of legal age to form a binding contract and meet all of the foregoing eligibility requirements. If you are using the Platform on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

To access certain features of the Platform, you may be required to create an account. When registering, you agree to provide accurate, current, and complete information and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us immediately at care@hinch.in of any unauthorised use of your account or any other breach of security. We reserve the right to suspend or terminate your account if any information provided during registration proves to be inaccurate, not current, or incomplete.

HINCH offers a range of home interior materials, including but not limited to plywood, laminates, hardware, decoratives, wall panels, louvers, veneer, and allied interior products. We make every effort to display product descriptions, images, specifications, and prices as accurately as possible. However, we do not warrant that product descriptions, colours (due to monitor variations), or other content on the Platform are completely accurate, reliable, current, or error-free.

All prices listed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. We reserve the right to modify prices at any time without prior notice. In the event of a pricing error, we reserve the right to cancel orders placed at the incorrect price and will issue a full refund for any payments already made.

When you place an order through HINCH, it constitutes an offer to purchase. We reserve the right to accept or reject any order at our discretion, including but not limited to orders where products are unavailable, there are errors in pricing or product information, or fraud is suspected.

We accept the following payment methods: UPI, Credit/Debit Cards, Net Banking, Mobile Wallets, EMI options, and Cash on Delivery (COD) where available. All electronic payments are processed through secure, PCI-DSS compliant payment gateways. HINCH does not store your full credit/debit card details on our servers.

Visiting the Platform, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communication be in writing.

All content on the Platform — including but not limited to text, graphics, logos, the HINCH brand name, images, product photographs, UI design, software, and compilation — is the property of Homenest Retail Tech India Pvt Ltd or its content suppliers and is protected by Indian and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any content from the Platform without our express prior written consent.

You agree not to engage in any of the following activities while using the Platform:

• •Using the Platform for any unlawful purpose or in violation of these Terms
• •Attempting to gain unauthorised access to any part of the Platform, other accounts, computer systems, or networks
• •Using any automated system, including bots, crawlers, or scrapers, to access or extract data from the Platform
• •Impersonating another person or entity, or misrepresenting your affiliation with a person or entity
• •Interfering with or disrupting the integrity or performance of the Platform or its services
• •Uploading or transmitting viruses, malware, or any code of a destructive nature
• •Engaging in any activity that could damage, disable, or impair the Platform

To the fullest extent permitted by applicable law, HINCH and its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform.

Our total liability to you for any claim arising from or related to the Platform or any product purchased through it shall not exceed the amount paid by you for the specific product giving rise to such claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

You agree to defend, indemnify, and hold harmless Homenest Retail Tech India Pvt Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.

Before initiating any formal legal proceedings, both parties agree to first attempt to resolve disputes through good-faith negotiation for a period of at least 30 days. If the dispute cannot be resolved through negotiation, either party may pursue resolution through the appropriate legal channels.

We reserve the right to terminate or suspend your account and access to the Platform, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
